Welcome to pHeminity — your personal intimate health assistant.

These Terms of Service explain how you may use the pHeminity website, mobile application, connected products and related services provided by pHeminity Sp. z o.o. (“pHeminity”, “we”, “us” or “our”).

By creating an account or using our Services, you agree to these Terms. If you do not agree with them, please do not use the Services.

01   About pHeminity

pHeminity develops technology designed to help women understand, monitor and manage aspects of intimate health.

Our ecosystem may include the pHeminity mobile application, pH testing solutions, connected devices such as pHemRing, digital insights and other products or services introduced by pHeminity.

Depending on the product and its regulatory status, the Services may allow you to record, visualise and analyse information such as vaginal pH, temperature and other measurements.

02   Health Information & Medical Disclaimer

pHeminity is designed to support intimate health awareness and informed conversations. It is not a substitute for professional medical advice, diagnosis or treatment unless expressly stated otherwise in the applicable product documentation and permitted by applicable law.

Information, measurements, trends and AI-generated insights provided through the Services should not be used as the sole basis for making medical decisions.

If you have symptoms, concerns about your health, believe you may have an infection, are pregnant and have health concerns, or require medical advice, consult an appropriately qualified healthcare professional.

In an emergency, contact your local emergency medical service.

Do not delay seeking medical care because of information obtained through pHeminity.

03   Your pHeminity Account

Some features of the Services require you to create an account.

You agree to provide accurate and current information and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account.

If you believe that someone has accessed your account without permission, please contact us promptly.

04   Google Sign-In

pHeminity may allow you to create or access your account using Google Sign-In.

If you choose this option, information associated with your Google account may be shared with pHeminity in accordance with the permissions you authorise and our Privacy Policy.

Your use of Google services is also subject to Google’s applicable terms and policies.

05   Using pHeminity

pHeminity is built to help you Test · Track · Act and better understand changes in your intimate health.

You agree to use the Services only for their intended purpose and in accordance with applicable law.

You must not:

  • use the Services for unlawful purposes;
  • attempt to gain unauthorised access to the Services or another user’s account;
  • interfere with or disrupt the Services;
  • introduce viruses, malware or other harmful code;
  • reverse engineer or attempt to extract source code except where permitted by law;
  • copy, reproduce or distribute the Services without our permission; or
  • misuse information obtained through the Services.

06   pHemRing & Connected Devices

Where available, pHemRing and other connected pHeminity products may collect measurements and transmit information to the pHeminity application.

Connected products must be used according to their applicable instructions, warnings and intended purpose.

Measurements may be affected by biological, environmental, technical and other factors. No measurement can be guaranteed to be perfectly accurate under all circumstances.

The functionality, availability and intended use of pHemRing may vary depending on the product version, regulatory status and geographic location.

07   Your Health Data

We understand that intimate health information is highly personal.

Depending on the Services you use, pHeminity may process account information, device information, measurements and other information relating to your health.

We process personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (EU) 2016/679), where applicable.

08   AI-Powered Insights

Some pHeminity features may use artificial intelligence or machine-learning technologies to analyse information and provide personalised insights.

AI-generated information may contain errors, may not reflect your complete health situation and should not be interpreted as a medical diagnosis unless expressly identified as such in the applicable product documentation.

You remain responsible for decisions relating to your health and should seek professional medical advice where appropriate.

09   Accuracy & Availability

We make reasonable efforts to provide reliable and useful Services. However, we do not guarantee that the Services will always be:

  • accurate or complete;
  • available without interruption;
  • free from errors;
  • compatible with every device or operating system; or
  • free from data loss or technical failures.

Technical measurements may be subject to limitations inherent in sensors, hardware, software, connectivity and biological variability.

10   Intellectual Property

pHeminity and its licensors own all applicable intellectual property rights in the Services, including software, interfaces, designs, graphics, text, databases, trademarks and other materials.

You receive a limited, non-exclusive, non-transferable and revocable right to use the Services for their intended purpose.

Your use of pHeminity does not transfer ownership of any intellectual property to you.

11   Your Content

Where pHeminity allows you to submit information, comments, feedback or other content, you retain ownership of that content.

You grant pHeminity the limited rights necessary to host, process, transmit and display that content for the purpose of providing the Services, subject to our Privacy Policy and applicable law.

12   Third-Party Services

pHeminity may integrate with third-party services, including authentication providers, cloud infrastructure, analytics services, app stores and communication services.

Third-party services may be subject to their own terms and privacy policies. pHeminity is not responsible for services that it does not control.

13   Fees & Purchases

Certain pHeminity products or services may be offered for a fee.

Where applicable, pricing, payment terms, subscription conditions, cancellation rights and refund information will be presented before you complete a purchase.

Nothing in these Terms limits mandatory consumer rights that apply under applicable law.

14   Service Changes

pHeminity is continuously developing.

We may update, modify, suspend or discontinue parts of the Services when reasonably necessary, including for technical, security, regulatory or product-development reasons.

Where required by law, we will provide appropriate notice of significant changes.

15   Account Suspension & Termination

You may stop using pHeminity at any time.

We may suspend or terminate access where reasonably necessary, including where you materially breach these Terms, create a security or legal risk, use the Services unlawfully or where required by law.

16   Liability

To the maximum extent permitted by applicable law, pHeminity will not be liable for indirect, incidental, special or consequential losses arising from your use of the Services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud or other mandatory statutory liability.

17   Security

We take reasonable technical and organisational measures to protect the Services and information processed through them.

However, no online service can be guaranteed to be completely secure. You are responsible for maintaining the security of your account, password and devices.

18   Consumer Rights

If you are a consumer, nothing in these Terms is intended to exclude or restrict rights that cannot legally be excluded or restricted under applicable consumer protection law.

19   Governing Law

These Terms are governed by the laws applicable to pHeminity Sp. z o.o., subject to mandatory consumer protection provisions that apply to you.

If you are a consumer residing in another country of the European Economic Area, mandatory consumer protection rights applicable in your country of residence will not be affected by this provision.

20   Changes to These Terms

We may update these Terms from time to time.

When material changes are made, we will take reasonable steps to notify users where required by applicable law.

The updated version will always be published on this page together with a new “Last updated” date.
